1. Introduction & Acceptance of These Terms

These Terms & Conditions ("Terms") govern your access to and use of the SimJuno website, applications, and travel eSIM products and services (collectively, the "Services") provided by SimJuno ("SimJuno", "we", "us", or "our"), a company registered under company number 42006077.

By creating an account, placing an order, installing an eSIM, or otherwise using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, you must not use the Services.

If you use the Services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms, in which case "you" refers to that entity.

2. Definitions

"eSIM" means an embedded SIM profile that is delivered and installed digitally (for example via a QR code or in-app installation) and enables your device to connect to mobile networks without a physical SIM card.

"Data Plan" means a prepaid package of mobile data (and, where expressly offered, other connectivity services) associated with an eSIM, with the data allowance, validity period, and coverage area described on the relevant product page at the time of purchase.

"Device" means the smartphone, tablet, or other equipment on which you install an eSIM.

"Network Operators" means the third-party mobile network operators and connectivity aggregators whose networks and infrastructure are used to deliver connectivity under a Data Plan.

3. Eligibility & Accounts

You may use the Services only if you are at least 18 years old (or the age of legal majority in your jurisdiction) and legally capable of entering into a binding contract.

To purchase and manage eSIMs you may need to create an account. You agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us without undue delay at [email protected] if you suspect any unauthorized use of your account.

We may refuse, suspend, or close accounts at our reasonable discretion, including where we suspect fraud, abuse, or a breach of these Terms.

4. Our Services

SimJuno sells prepaid travel eSIMs and Data Plans that provide mobile data connectivity in the destinations described on our website. Connectivity is delivered over the networks of third-party Network Operators; SimJuno does not own or operate mobile networks.

Unless expressly stated otherwise for a specific Data Plan, our eSIMs are data-only and do not include voice calls, SMS, or access to emergency services (such as 112 or 911). You are responsible for ensuring you have an alternative means of contacting emergency services while travelling.

The details of each Data Plan — including coverage area, data allowance, validity period, and any usage conditions — are set out on the relevant product page at the time of purchase and form part of your contract with us.

5. Device Compatibility & Your Responsibilities

eSIMs work only on devices that are eSIM-compatible and not locked to a specific carrier. It is your responsibility to verify, before purchase, that your Device supports eSIM and is carrier-unlocked. We publish a non-exhaustive list of supported devices on our website for guidance, but we cannot guarantee compatibility with every device, operating system version, or regional device variant.

You are responsible for correctly installing and configuring the eSIM in accordance with our instructions (including enabling data roaming where instructed) and for keeping installation details, such as QR codes and activation codes, secure. Each eSIM can typically be installed only once; deleting an installed eSIM from your Device may render it permanently unusable, and we are not obliged to replace eSIMs deleted in error.

Except where required by applicable law, refunds will not be provided where the Services could not be used because your Device is incompatible, carrier-locked, or incorrectly configured.

6. Orders, Payment & Pricing

All prices are shown at checkout in the applicable currency and, unless stated otherwise, include applicable VAT or sales taxes. We may change our prices at any time; price changes do not affect orders that have already been placed.

Payment is due in full at the time of ordering and is processed by third-party payment providers. By submitting an order, you authorize us and our payment providers to charge your chosen payment method. Your contract with us is concluded when we confirm your order by email or make the eSIM available in your account, whichever occurs first.

We may refuse or cancel an order where we reasonably suspect fraud or misuse, where an obvious pricing or description error has occurred, or where we are required to do so by law. If we cancel an order you have already paid for, we will refund the amount paid.

Promotional codes and coupons are subject to their own conditions, are non-transferable, have no cash value, and may be modified or withdrawn at any time. We may reverse or reclaim benefits obtained through misuse of a promotion.

7. Activation, Validity & Data Usage

Each Data Plan has a validity period that begins as described on the relevant product page — typically upon installation or activation of the eSIM, upon first connection to a supported network, or on a specified start date. Once started, the validity period runs continuously and is not paused or extended by lack of use.

Unused data expires at the end of the validity period or upon consumption of the data allowance, whichever occurs first, and is not refundable, transferable, or convertible into credit unless expressly stated otherwise. Top-ups, where offered, are subject to the conditions displayed at the time of purchase.

Data usage is measured by our systems and those of our Network Operators, and those records will be the basis for determining your remaining allowance, absent manifest error.

8. Refunds, Cancellations & Right of Withdrawal

If you are a consumer in the European Union or another jurisdiction that provides a statutory right of withdrawal for distance purchases, you may in principle withdraw from your purchase within 14 days of the order without giving a reason. However, by installing or activating your eSIM or starting your Data Plan within this period, you expressly request immediate performance of the service and acknowledge that you lose your right of withdrawal once the service has been fully performed. If you withdraw after performance has begun but before it is complete, we may deduct a proportionate amount for the service already provided.

In addition to your statutory rights, we will refund or replace an eSIM or Data Plan that has not been installed or activated if you request this from [email protected] within 30 days of purchase, and we will refund or replace a Data Plan that cannot be used due to a technical fault attributable to us that we are unable to resolve within a reasonable time. Please include your order number and a description of the issue in any refund request.

Unless required by applicable law, refunds are not available for: Data Plans that have been fully consumed or have expired; inability to use the Services due to an incompatible, carrier-locked, or misconfigured Device; failure to follow our installation instructions; deletion of an installed eSIM; or charges imposed by third parties (such as your bank or home carrier).

Nothing in this section limits or excludes any non-waivable statutory rights you have as a consumer, including statutory guarantees of conformity.

9. Fair & Acceptable Use

The Services are intended for normal personal use while travelling. You agree not to: use the Services for any unlawful, fraudulent, or abusive purpose; resell, rent, or commercially redistribute eSIMs or connectivity without our prior written consent; use the Services in a way that damages, overloads, or degrades any network or service (including sending spam or conducting denial-of-service attacks); use the Services as a permanent replacement for fixed-line or home internet in a single location where the Data Plan is marketed for travel; or attempt to circumvent usage limits, security measures, or geographic restrictions.

Where a Data Plan is described as "unlimited" or with a similarly broad allowance, it remains subject to fair use: we or our Network Operators may reduce speeds, apply traffic management, or suspend service where usage is exceptional, abnormal, or inconsistent with typical personal travel use.

You must comply with the laws and regulations of each country in which you use the Services. We may suspend or terminate the Services in accordance with section 16 if you breach this section.

10. Network Availability & Coverage

Connectivity depends on the coverage, capacity, and technical characteristics of third-party networks, as well as on factors outside our control such as your location, your Device, terrain, buildings, weather, network congestion, and local regulatory restrictions. Coverage maps and speed indications published by us or by Network Operators are estimates only and do not guarantee the availability, quality, or speed of service at any particular time or place.

The Services may be temporarily unavailable due to maintenance, network changes, or events beyond our reasonable control. Where we become aware of significant planned disruption affecting your active Data Plan, we will make reasonable efforts to inform you.

The Network Operators used to deliver a Data Plan may change. We may migrate connectivity to alternative networks provided the coverage remains materially equivalent to what was described at the time of purchase.

11. Intellectual Property

The Services, including the website, applications, software, text, graphics, logos, and the SimJuno name and marks, are owned by SimJuno or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for personal, non-commercial purposes in accordance with these Terms.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from any part of the Services except with our prior written consent or to the extent permitted by applicable law.

12. Privacy & Data Protection

Our collection and use of personal data in connection with the Services is described in our Privacy Policy, available on our website. By using the Services, you acknowledge that personal data such as account details, order information, and technical usage data will be processed as described in the Privacy Policy.

Network Operators may also process traffic and location data as necessary to deliver connectivity, in accordance with their own legal obligations in the jurisdictions where they operate.

13. Disclaimer of Warranties

Except as expressly set out in these Terms, and to the maximum extent permitted by applicable law, the Services are provided "as is" and "as available", and we disclaim all implied warranties and conditions, including any warranty of merchantability, fitness for a particular purpose, or uninterrupted or error-free operation. In particular, we do not warrant any specific connection speed, latency, or continuous coverage.

Nothing in these Terms excludes or limits any warranty, guarantee, or consumer right that cannot be excluded or limited under applicable law, including statutory guarantees that services will be provided with reasonable care and skill and that digital content will conform to the contract.

14. Limitation of Liability

To the maximum extent permitted by applicable law: (a) we are not liable for indirect or consequential losses, including loss of profits, loss of business, loss of data, or losses arising from your inability to send or receive communications (including any inability to contact emergency services); and (b) our total aggregate liability arising out of or in connection with the Services is limited to the total amount you paid to SimJuno for the Services in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for any other liability that cannot be limited or excluded under applicable law.

15. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless SimJuno and its officers, employees, and agents from and against any claims, damages, losses, and reasonable expenses (including reasonable legal fees) arising out of your breach of these Terms, your unlawful use of the Services, or your infringement of the rights of any third party.

This section does not apply to consumers where and to the extent such an indemnity is not permitted under mandatory consumer protection law.

16. Suspension & Termination

We may suspend or terminate your access to the Services, in whole or in part, with immediate effect if: you materially breach these Terms (including the fair use rules in section 9); we reasonably suspect fraud, unlawful activity, or abuse; we are required to do so by law, a competent authority, or a Network Operator; or continued provision would harm our networks, systems, or other users. Where practicable, we will notify you of the suspension or termination and its reason.

You may stop using the Services and request closure of your account at any time by contacting [email protected]. Termination does not entitle you to a refund of unused data or fees except as set out in section 8 or as required by applicable law.

Provisions of these Terms that by their nature should survive termination — including sections on intellectual property, disclaimers, limitation of liability, and governing law — survive any termination or expiry.

17. Changes to These Terms

We may update these Terms from time to time, for example to reflect changes in our Services, in legal or regulatory requirements, or in the conditions imposed by Network Operators. The current version will always be published on this page together with its "last updated" date, and for material changes we will give you reasonable advance notice, for example by email or through the Services.

Changes apply to purchases made after they take effect and will not retroactively reduce your rights in respect of Data Plans you have already purchased, except where a change is required by law. If you do not agree with the updated Terms, you should stop using the Services and refrain from making further purchases.

18. Governing Law & Dispute Resolution

These Terms, and any dispute or claim arising out of or in connection with them or the Services, are governed by the laws of the Netherlands, without prejudice to any mandatory consumer protection provisions of the law of the country in which you habitually reside.

If you have a complaint, please contact us first at [email protected] so that we can try to resolve it informally. If you are a consumer in the European Union, you may also submit a complaint through the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

Subject to any mandatory rules granting you the right to bring proceedings in the courts of your country of residence, the courts of the Netherlands have jurisdiction over disputes arising out of or in connection with these Terms.

19. General Provisions

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision will be deemed replaced by a valid provision that most closely reflects its original intent.

These Terms, together with our Privacy Policy and the Data Plan details presented at the time of purchase, constitute the entire agreement between you and SimJuno regarding the Services. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.

We may assign our rights and obligations under these Terms to an affiliate or in connection with a merger, reorganization, or sale of our business, provided this does not reduce your rights under these Terms. You may not assign your rights or obligations under these Terms without our prior written consent.

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, war, terrorism, labour disputes, governmental actions, or failures of Network Operators or other third-party infrastructure.
